1. Scope and acceptance
These terms govern use of www.qmskochi.com, operated by Quality Machines & Spares (“QMS”, “we”, “us” or “our”), Kochi, Kerala, India. Please read them before using the website. Where a feature requires express acceptance, you must accept these terms before using that feature. If you do not agree, please discontinue use.
These terms cover website use. A purchase or service arrangement is also governed by the quotation, order confirmation and other terms expressly agreed for that transaction. If there is a conflict on a transaction-specific matter, the expressly agreed transaction terms prevail, subject to applicable law.
2. Eligibility and information you provide
You must be at least 18 and legally capable of entering a contract to place an order or accept a commercial commitment. If acting for an organisation, you must have authority to do so. Provide accurate contact and requirement details and only information you are authorised to share.
3. Product information and suitability
The website provides information about pumpsets, power tools, woodworking machinery, construction and fabrication equipment, air compressors, spares and related services. Images, brochures, specifications and descriptions are for general reference and may change as manufacturers update products.
Before ordering, confirm the exact model, capacity, dimensions, power requirements, accessories, compatibility, performance conditions and suitability with QMS in writing. General website guidance does not replace a site assessment, manufacturer instructions or advice from a qualified professional. Nothing in these terms excuses misleading descriptions or removes obligations imposed by law.
4. Enquiries, quotations and orders
Submitting a form, requesting a quotation or sending a message does not by itself create an accepted order. A contract is formed when QMS and the customer agree the relevant commercial terms and QMS confirms acceptance in writing.
Prices, taxes, freight, installation charges, payment schedules, stock availability and delivery estimates are as stated in the applicable quotation or order confirmation. Any quotation validity period applies as specified. We will communicate any identified error or proposed change before acceptance; an accepted contract will not be changed unilaterally contrary to its terms or applicable law.
5. Delivery, installation and customer responsibilities
Delivery and installation arrangements depend on the product, location, availability and agreed scope. Site preparation, unloading, electrical supply, foundations, access, permissions and operator training responsibilities must be confirmed in the quotation or order terms.
Equipment must be installed, operated and maintained by appropriately qualified persons following manufacturer instructions and applicable safety requirements. Contact us if the equipment or application differs from the agreed requirements.
6. Warranty, service, cancellations and returns
Applicable manufacturer warranties and any additional commitments made by QMS will be identified in the transaction documents. Warranty scope, duration, exclusions, service process and transport or visit charges depend on the applicable terms and law. QMS will assist with valid warranty and service enquiries within its agreed role.
Cancellation, return, replacement and refund conditions must be agreed or disclosed for the particular transaction. This website agreement does not impose a blanket “no refund” or “no replacement” rule. Nothing limits rights concerning defective goods, misdescription, deficient services or other protections that cannot lawfully be excluded.
7. Acceptable use
You must not use the website for unlawful or fraudulent activity; impersonate others; submit malicious code or misleading enquiries; attempt unauthorised access; interfere with security or availability; or copy content or collect information in a way that infringes rights or applicable law.
We may restrict access reasonably necessary to protect the website or respond to misuse. Such restrictions do not cancel accrued contractual or statutory rights.

External websites and platforms have their own terms and privacy policies. QMS does not control their content or availability. We take reasonable care with our website but cannot guarantee uninterrupted access, freedom from technical errors or that every item remains current at all times. 10. Liability and statutory rights
To the extent permitted by law, QMS is not liable for indirect or consequential losses arising solely from website use, such as lost business opportunities caused by an interruption. This limitation does not exclude liability for fraud, wilful misconduct, negligence causing death or personal injury, or any liability that cannot lawfully be excluded or limited.
These terms do not exclude statutory consumer rights, product liability obligations or express commitments in an accepted contract. Liability relating to a sale or service is governed by the applicable transaction terms and law.

Our Privacy Policy explains how we handle personal information. Acceptance of these website terms does not automatically authorise optional marketing or unrelated personal-data processing.
12. Governing law and disputes
These terms are governed by Indian law. Please first contact QMS to seek an amicable resolution. Subject to mandatory law, courts of competent jurisdiction in Ernakulam, Kerala will have jurisdiction over website-related disputes. This does not restrict a consumer’s right to approach a consumer commission or another authority or forum available under applicable law.
13. Updates and severability
We may revise these terms prospectively by publishing an updated version and effective date. Material changes will be brought to users’ attention where appropriate, and express acceptance obtained where required. Updates do not retrospectively alter accepted orders. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
